By using this Site, you are indicating that you agree to be bound by all of the following terms and conditions of use.

In these terms and conditions �the Bank� refers to Bahamas Financial Services Board of Bahrain E.C. and its affiliates and subsidiaries, �the Site� refers to the Internet Banking Site of Bahamas Financial Services Board of Bahrain, �the User or Users� refers to the visitors to / users of the Site and �the Agreement� refers to these terms and conditions of access to / use of the Site.

1. This site has been prepared by the Bank solely for information purposes and it is not an offer to buy or sell or a solicitation of an offer to buy or sell any investment, security or instrument or to participate in any particular investment strategy, which may be referred to in or referenced on the Site.

2. The information and materials contained in this Site, including text, graphics, links or other items are provided "as is", "as available". The Bank does not warrant the accuracy, adequacy or completeness of the information and materials and expressly disclaims liability for errors or omissions in the information and materials. No warranty of any kind, implied, expressed or statutory including but not limited to the warranties of non-infringement of third party rights, title, merchantability, fitness for a particular purpose and freedom from computer virus, is given in conjunction with the information and materials.

3. Not all products and services are available to a User in all geographic areas. The eligibility of a User in respect of a particular product and/or service is subject to the final determination of the Bank.

4. The Bank reserves the right to change the Agreement and notices applicable to the use of the Site and reserves the right to modify any features of any products or services offered by the Bank on the Site and any information found on the Site. The User is responsible for regularly reviewing the terms and conditions. Continued use of the Site after any such changes shall constitute the consent of the User to such changes.

5. The User agrees and confirms to the Bank that the User is using the Bank�s Internet Service at his/her own risk and responsibility. The User shall be fully responsible and accountable for the confidentiality of his/her PIN.

6. The Bank reserves the right to refuse, for any reason whatsoever: (a) to provide electronic banking service to a User; and (b) any electronic banking Instructions or inquiries received from a User.

7. The User shall be charged such fees (for subscription to, and maintenance and utilization of, the Bank�s various electronic banking services) as the Bank may prescribe from time to time. The Bank reserves the right to modify such fees at any time, and shall notify the User accordingly in the event of any such modification. The User hereby authorizes the Bank to debit any of the User�s accounts with the Bank (or such specific account as the User may, from time to time, specify in writing) for any such charges.

8. All information, content, materials, products (including, but not limited to text, content, photographs, graphics, video and audio content) is protected by copyright in favor of the Bank under applicable copyright laws, as well as under general intellectual property law.

9. All information submitted to the Bank via this Site shall be deemed and remain the property of the Bank and the Bank shall be free to use, for any purpose, any idea, concept, know-how or technique contained in information a User to this Site provides the Bank through this Site.

10. The Bank shall not be bound by the obligation of confidentiality regarding information submitted by a User unless the User has a direct customer relationship with the Bank or unless specifically agreed in writing or required under applicable law.

11. The User shall not copy, reproduce, sell, redistribute, publish, enter into a database, display, perform, modify, transmit, license, create derivatives from, transfer or in any way exploit any part of any information, content, materials, services available from or through the Site, except that the User may download material from this service for his/her own personal, non-commercial use.

12. As a condition of the User�s use of the Site the User warrants that he/she shall not use the Site for any purpose that is unlawful, or prohibited by these terms and conditions. The User shall not use the Site in any manner that could damage, disable or impair the Site or interfere with any other party's use or enjoyment of the Site.

13. The Bank may withdraw/supersede the Agreement at any time whatsoever and without prior notice.

14. This Site may give a User the ability to communicate electronically with the Bank through electronic mail (e-mail). The User agrees not to use e-mail to transmit orders to purchase or sell a security, to transfer or disburse funds, to transmit any personal credit information (including credit card numbers), or to give the Bank any instructions that are time-sensitive or require a signature. The Bank shall not be liable for any actions taken or any omissions to act as a result of any e-mail message the User sends to the Bank. All e-mail sent to and from the Bank is subject to monitoring, review by, or disclosure to someone other than the recipient. Additionally, e-mail sent to and from the Bank�s address may be retained by the Bank�s corporate e-mail system.

15. The Bank may, in its sole discretion, disclose information relating to the transactions or experiences with the User to consumer reporting agencies and similar organizations.

16. Except as expressly set forth in this Agreement, the Bank and its directors, officers, employees, affiliates, vendors, licensors and agents expressly disclaim all express and implied warranties, including, without limitation, warranties of merchantability, fitness for a particular purpose, and error-free and uninterrupted service.� In no event shall the Bank be liable for any damages, including without limitation direct or indirect, special, incidental, or consequential damages, losses or expenses arising in connection with this Site or any linked site or use thereof or inability to use by any party, or in connection with any failure of performance, error, omission, interruption, defect, delay in operation or transmission, computer virus or line or system failure, even if the Bank, or representatives thereof, are advised of the possibility of such damages, losses or expenses.

17. The User hereby agrees to indemnify and hold the Bank harmless against any and all damages, losses, expenses and costs (including legal costs) suffered or incurred by the Bank in connection with or arising from (1) the User�s access of this Site and/or use of the online services, or (2) any other party's access of this Site and/or use of the online services using the User�s �user id� and/or �login password�, or (3) the User�s breach of any of the Agreement or (4) any other party's breach of any of the Agreement where such party was able to access this Site and/or use the online services by using the User�s �user id� and/or �login password�.

18. The courts of the State of Bahrain shall have exclusive jurisdiction as regards any claims or matters arising out of dealings with the Bank and the laws of the State of Bahrain shall govern any and all disputes.

19. The above constitutes the Bank�s terms and conditions of access to the Site and are in addition to, and do not change or cancel, any other agreement between the User and the Bank governing the User�s relationship with the Bank. The Bank reserves the right, at its sole discretion, to change, modify, add, remove portions of these terms at any time. The User shall not be permitted to modify, alter, amend, omit or delete any part thereof.
